§ 125.365 Alternate airport for depar-
ture.
(a) If the weather conditions at the
airport of takeoff are below the landing
minimums in the certificate holder’s
operations specifications for that air-
port, no person may release an airplane
from that airport unless the flight re-
lease specifies an alternate airport lo-
cated within the following distances
from the airport of takeoff:
(1)
Airplanes having two engines.
Not
more than 1 hour from the departure
airport at normal cruising speed in
still air with one engine inoperative.
(2)
Airplanes having three or more en-
gines.
Not more than 2 hours from the
departure airport at normal cruising
speed in still air with one engine inop-
erative.
(b) For the purposes of paragraph (a)
of this section, the alternate airport
weather conditions must meet the re-
quirements of the certificate holder’s
operations specifications.
(c) No person may release an airplane
from an airport unless that person lists
each required alternate airport in the
flight release.
§ 125.367 Alternate airport for destina-
tion: IFR or over-the-top.
(a) Except as provided in paragraph
(b) of this section, each person releas-
ing an airplane for operation under IFR
or over-the-top shall list at least one
alternate airport for each destination
airport in the flight release.
(b) An alternate airport need not be
designated for IFR or over-the-top op-
erations where the airplane carries
enough fuel to meet the requirements
of §§ 125.375 and 125.377 for flights out-
side the 48 conterminous States and
the District of Columbia over routes
without an available alternate airport
for a particular airport of destination.
(c) For the purposes of paragraph (a)
of this section, the weather require-
ments at the alternate airport must
meet the requirements of the opera-
tor’s operations specifications.
(d) No person may release a flight un-
less that person lists each required al-
ternate airport in the flight release.
§ 125.369 Alternate airport weather
minimums.
No person may list an airport as an
alternate airport in the flight release
unless the appropriate weather reports
or forecasts, or any combination there-
of, indicate that the weather condi-
tions will be at or above the alternate
weather minimums specified in the cer-
tificate holder’s operations specifica-
tions for that airport when the flight
arrives.
§ 125.371 Continuing flight in unsafe
conditions.
(a) No pilot in command may allow a
flight to continue toward any airport
to which it has been released if, in the
opinion of the pilot in command, the
flight cannot be completed safely, un-
less, in the opinion of the pilot in com-
mand, there is no safer procedure. In
that event, continuation toward that
airport is an emergency situation.
§ 125.373 Original flight release or
amendment of flight release.
(a) A certificate holder may specify
any airport authorized for the type of
airplane as a destination for the pur-
pose of original release.
(b) No person may allow a flight to
continue to an airport to which it has
been released unless the weather condi-
tions at an alternate airport that was
specified in the flight release are fore-
cast to be at or above the alternate
minimums specified in the operations
specifications for that airport at the
time the airplane would arrive at the
alternate airport. However, the flight
release may be amended en route to in-
clude any alternate airport that is
within the fuel range of the airplane as
specified in § 125.375 or § 125.377.
(c) No person may change an original
destination or alternate airport that is
specified in the original flight release
to another airport while the airplane is
en route unless the other airport is au-
thorized for that type of airplane.
(d) Each person who amends a flight
release en route shall record that
amendment.
